Purchasing Terms and Conditions
- This purchase order, when CONFIRMING is not indicated, is an offer to purchase the indicated goods or services. Acceptance of this purchase order is evidence that a contract exists between the vendor (contractor) and the Village of Mount Prospect. The Village will not accept contracts drafted or issued by the vendor.
- This purchase order, when CONFIRMING is indicated, is issued as evidence that a contractual agreement has been reached between the vendor (contractor) and the Village of Mount Prospect. The Village will not accept contracts drafted or issued by the vendor.
- All applicable portions of the Uniform Commercial Code shall govern this contract between the vendor and the Village of Mount Prospect.
- All pricing must be FOB delivery point. Where shipping costs are not included in the stated price on the purchase order, the vendor shall prepay such costs and add to the invoice.
- COD shipments will not be accepted unless specific prior arrangements have been made to do so.
- Where circumstances or conditions exist preventing effective inspection of the goods at the time of delivery, the Village of Mount Prospect reserves the right to inspect the goods at a reasonable time subsequent to delivery.
- All invoices are to be directed to the Village of Mount Prospect, Finance Department, 50 South Emerson Street, Mount Prospect, IL 60056.
- The Village of Mount Prospect approves accounts payable twice monthly. Average payment time is 21 days after receipt of an invoice.
- The Village of Mount Prospect is exempt from payment of State, Federal, Excise, and Illinois Retailers Occupational Taxes. The Village's Tax Exemption number is E9998-1475.
- Where applicable, in contracts exceeding $10,000.00, the vendor (contractor) shall be governed by the Illinois Prevailing Wage Act, Public Act 86-799.
- The vendor must be compliant with all applicable provisions of the Illinois Human Rights Act, the Public Works Employment Discrimination Act, the U.S. Civil Rights Act and Section 504 of the Federal Rehabilitation Act, and the Americans with Disabilities Act, as well as all applicable regulations
- The vendor is compliant with the Drug Free Workplace Act.
- The vendor or contractor is not barred from contracting with a unit of state or local government as a result of a violation of either Section 33E-3 or 33E-4 of the Criminal Code of 1961.
- The Vendor is required to submit a Material Safety Date Sheet (MSDS) prior to or at the time of delivery, if any toxic substance is contained in the product per Public Act 83-240.
